Mediation Philosophy

A successful mediation begins with understanding the nature of the dispute. I have mediated cases since 2011, including probate, business, and personal injury cases. This experience, along with with my civil litigation practice of over 40 years, allows me to understand a broad range of civil disputes. I am now focused on mediations.

My civil trial practice has taught me people often feel out of place in the legal system. By establishing a relationship with the parties in the mediation, I try to put them at ease with the mediation process. I also bring to the mediation process the passion I brought to my own cases.

Motivation of the parties is often equally as important as the facts of the case. But often, the parties’ motivations are not clear. By carefully listening to the parties and relating a bit of my own background, I am usually able to help the parties bring their true motivations into focus.

Many times the parties want a resolution that is simply not going to take place. My background in resolving difficult issues with my own clients helps me in this process. My extensive trial background can provide a dose of reality regarding the cost, complexity, and uncertainty of litigation.
